Privacy Policy for TakeStage Interactive Application

Introduction

Welcome to TakeStage, a live collaborative remote recording studio application available on iOS and Web platforms. The Service enables performing artists, educators, and collaborators to join real-time video calls for music auditions and performances, remotely control devices for high-quality recordings, and create durable video/audio content that persists even during internet interruptions. Key features include multi-participant video calls, remote control of camera and audio settings, automatic synchronous uploads to our Content Management System (CMS), sharing recordings with select participants and generative AI transcriptions and music analysis. This privacy policy outlines how we collect, use, store, and protect your personal information when you use our services. 

By using TakeStage, you agree to the terms of this Privacy Policy. This Policy applies to users worldwide. Residents of certain jurisdictions (e.g., California, EU/UK) have additional rights detailed below.

Compliance with Privacy Laws

This Policy complies with applicable laws, including the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), other US state privacy laws, the EU General Data Protection Regulation (GDPR), and the UK Data Protection Regime (including the Data (Use and Access) Act 2025). We process data based on legal grounds such as consent, legitimate interests, or contract performance. For users in the EU/UK, we transfer data outside the EEA/UK using Standard Contractual Clauses or other approved mechanisms to ensure adequate protection. We do not use your data to train AI models without your explicit opt-in consent.

  1. Information We Collect
  • Identifiers: When you create an account, we collect information such as your name, email address, and other contact information (user-provided).
  • Device Information: We collect information from your device, including IP address, device type, operating system, and unique device identifiers to improve your experience and troubleshoot issues (device-derived).
  • Usage Data: We gather data about your usage of the app, including participant information, session duration, and performance metrics to improve app functionality and user experience (automatically collected).
  • Audio/Visual and Precise Geolocation: When using the app to record collaborative sessions, we collect and store video and audio recordings, including metadata like the time, location, and participants involved in each session (user-generated and device-derived). Note that video/audio/location data may qualify as sensitive personal information (e.g., biometrics).
  • Transcriptions and AI-Generated Data: When enabled, we generate text transcriptions of sessions and AI outputs from music analysis (e.g., feedback on phrasing, style), including manifests (e.g., timestamps, speaker labels). These may contain inferences derived from audio/usage data for personalization and are potentially sensitive (e.g., voice biometrics).

  1. How We Use Your Information
  • Service Provision: Your personal information is used to provide you with access to TakeStage’s features, including live collaborative sessions, local recording, cloud upload services, content distribution, call transcriptions, and Generative AI music analysis (based on contract performance).
  • Enhancing User Experience: We analyze your usage data to identify performance issues, enhance features, and provide personalized user experiences (based on legitimate interests). If using AI/automation for personalization, transcription, or music analysis (e.g., generating feedback on performance style or phrasing), this may involve automated decision-making (ADM) with opt-out available via privacy@takestage.com. AI outputs may be inaccurate, incomplete, or biased due to the nature of AI technologies; we disclaim any warranties on their reliability—users should verify independently.
  • Content Storage & Sharing: Recordings created during sessions are stored locally on your device and uploaded to cloud storage (such as AWS S3) for further editing, distribution, and sharing via the TakeStage platform.
  • Security & Fraud Prevention: We use your device and usage data to detect potential security threats and unauthorized access to protect accounts and content (based on legitimate interests).

  1. Cloud Storage and Content Uploads 
  • TakeStage records video and audio streams locally on your device, even if there are interruptions in your internet connection. Once your session ends, the recordings are automatically uploaded to the cloud when connectivity is restored. These recordings, including any generated transcriptions or AI music analysis outputs, are stored on our cloud servers, accessible only to you, your collaborators, and anyone you choose to share the content with. 
  • We do not sell or share your personal information for monetary or other valuable consideration. Limited sharing occurs only with service providers under contract (e.g., for storage or AI processing). To exercise other privacy rights, contact us at privacy@takestage.live.
  1. Data Retention
  • Identifiers (e.g., Email): Retained indefinitely for account management or as necessary to provide services or for legal/business purposes.
  • User Metadata Information: We retain metadata related to your use of the platform (such as usernames, email addresses, content timestamps, stage names, and user-sharing information) for as long as necessary to provide services to you or as required for legal and business purposes. This includes compliance with applicable laws, security, fraud prevention, dispute resolution, and the enforcement of our policies. Upon user request for data deletion, we will anonymize or remove personal information except where retention is required by law or for legitimate business purposes. We minimize data per principles in applicable laws.
  • Audio/Visual Content (e.g., Video/Audio Recordings, Transcriptions, AI Outputs): For free accounts, TakeStage retains recorded video and audio content, transcriptions outputs for 30 days after the session, after which the content is permanently deleted from our servers unless otherwise specified by the user. For subscribed users, content is stored for the duration of the subscription, including AI music analysis, and users have control over the deletion or continued retention of their recordings. Upon cancellation or expiration of a subscription, content will remain accessible for 7 days, if not resubscribed 30 days after the expiration the content will be automatically deleted unless users take action.
  1. Data Security 
  • We implement a variety of security measures to protect your personal information and recordings, including encryption during transmission and storage. Only authorized personnel have access to your data, and we regularly review our security protocols to protect against unauthorized access. We conduct cybersecurity audits as required by law, including for AI-related processing.
  1. Marketing and Analytics
  • Marketing: With your consent, we may use your email address or other contact information to send you promotional materials about TakeStage’s services, updates, and features. You can opt out of these communications by following the unsubscribe instructions in the emails.
  • Analytics: We use analytics tools to analyze user behavior, measure app performance, and improve our services. This data helps us understand how users interact with our platform and where we can make improvements. The information collected for analytics is usually anonymized and aggregated, ensuring your personal information is not disclosed in the process. Opt-out of targeted advertising or profiling via privacy@takestage.com. We honor universal opt-out signals like Global Privacy Control (GPC).
  1. Sharing Your Information 
  • We will not share your personal information or content with third parties except:
  • To trusted service providers that help us operate the platform (e.g., cloud providers like AWS for storage, content delivery services, AI service providers for transcription and music analysis).
  • As required by law or to protect the rights, property, or safety of TakeStage, our users, or others. No sales or sharing for advertising; limited disclosures to service providers as described.
  1. Content Liability 
  • TakeStage provides a platform for users to engage in live teleconferencing and record collaborative content. We are not responsible for the content generated, shared, or stored during these sessions. All users are solely responsible for ensuring that their content complies with applicable laws and does not infringe upon the rights of others. TakeStage does not monitor or verify user-generated content, and any liability for the content, including legal or regulatory consequences, rests entirely with the user. TakeStage reserves the right to remove any content that violates our policies or legal obligations, but this does not create an obligation to review or moderate user-generated content. We may process content for compliance with laws (e.g., fraud prevention under DUAA).
  1. Your Control Over Your Data
  • Access and Manage Data: You can view, download, and manage your recordings directly through the TakeStage platform. You also have control over who you share your content with.
  • Deletion Requests: You may delete your account in the iOS app under the Profile section, or in the web/Android app via account settings, or submit a deletion request for your personal information, recordings, and other associated stored data (e.g., metadata or transcripts) at any time via privacy@takestage.com. We verify requests (e.g., via email confirmation) and respond within 45 days (or 30 days under GDPR). Upon confirmation, we will remove your data from our servers, subject to any legal obligations (e.g., fraud prevention).
  • Account Termination: If you terminate your account, we will delete your personal information and content within 30 days of the request.
  • Rights include access, correction, deletion, portability, opt-out of sales/sharing/profiling/ADM/AI processing (including transcription and music analysis), and objection (EU/UK). We do not sell or share PI, so no specific opt-out is needed—use the below for all rights requests. Submit requests via privacy@takestage.com or our online form. Appeals available. We will not discriminate against you for exercising these rights.
  1. Legal Compliance 
  • We may disclose your personal information as required by law, such as in response to legal processes like subpoenas, court orders, or regulatory requests. Additionally, we may share your data when we believe it is necessary to investigate, prevent, or take action against illegal activities, suspected fraud, threats to the safety of any person, or violations of our Terms of Service. We conduct risk assessments for high-risk processing as required, including for AI features.
  1. Children’s Privacy 
  • TakeStage is not intended for children under the age of 13. We do not knowingly collect personal information from children. If we discover that a child under 13 has provided us with personal information, we will promptly delete it. For users 13-16 in EU/UK or under state minor protections, we require verifiable parental consent for certain processing, including transcription of calls or AI music analysis involving minors’ voices or performances (e.g., biometrics).

  • We may update this privacy policy from time to time to reflect changes in our practices or legal requirements. We will notify you of significant changes via email or within the app. Please review the policy periodically to stay informed. We will post updates here and notify for material changes.
